Kim Dotcom to fight Sir John Key after Human Rights Tribunal case

Kim Dotcom has threatened to go after Sir John Key.

The controversial figure has vowed on Twitter he would take down the former Prime Minister and his Attorney General Chris Finlayson after the Human Rights Tribunal yesterday ruled the Crown broke the law by withholding information from him.
 



In July 2015, Mr Dotcom sent an urgent information privacy request to all 28 Ministers of the Crown, as well as almost all Government departments, asking for personal information they had on him, including under his previous names.

The requests were transferred to Mr Finlayson, who declined the Megaupload founder's requests on the grounds they were "vexatious" and trivial.

Privacy Foundation deputy chair Gehan Gunasekara believes both Sir John and the Attorney General have nothing to fear.

"Remember they would have acted in their capacity as Ministers of the Crown. If there is any liability it will be the Crown that's liable, it won't be them personally," Mr Gunasekara told RadioLIVE.

"Any order made against them is an order made against them in their capacity as a Minister."

Yet the Crown wouldn't easily wiggle their way out of this one, he said.

"Appeals are relatively hard to establish because they would have to show that there was a point of law or substantial mistake in the facts that the tribunal made."

Mr Dotcom has also called for the immediate resignation of the Privacy Commissioner.
